Fixed-Odds Betting

The Firm provides legal services to national and foreign clients interested in taking part in the Brazilian market for fixed-odds betting, as authorized by Law 13,756/2018, along with other agents of the productive chain, such as payment service providers, among others.

The services rendered by the Firm’s practitioners in this area include:

  • Consulting regarding the follow-on regulations to be issued by the National Secretariat of Prizes and Betting of the Ministry of Finance (SPA/MF);
  • Support to obtain licenses from the Ministry of Finance (MF);
  • Monitoring the progress of licensing processes with the relevant state and/or municipal authorities;
  • Consulting and support in corporate and tax matters for the establishment of local subsidiaries by foreign business groups;
  • Consulting in questions of consumer rights and relationship with the National Secretariat of Consumers (SENACON) of the Ministry of Justice and the various Consumer Complaint Offices (PROCONs) and other bodies of the National Consumer Defense System;
  • Legal assistance and representation in litigation;
  • Drafting and revision of the Terms and Conditions for Use of the websites of companies engaged in handling betting activity in Brazil;
  • Drafting and revision of rules and procedures for prevention and combating of money laundering and financing of terrorism, including know your customer (KYC) rules and procedures;
  • Consulting in questions involving manipulation of results;
  • Support for compliance the General Data Protection Law (LGPD), including analysis of internal procedures/processes and mapping of points to be revised;
  • Training of employees of companies offering betting services;
  • Evaluation of the practices adopted in relation to compliance with laws, regulations, policies and best international practices, as well as advice in the development of integrity procedures;
  • Support for the development of compliance programs and the formulation of policies and procedures for monitoring, internal controls and risk management;
  • Support to clients for the implementation of compliance training programs and internal ethics rules, as well as in conducting internal investigations, including the whistleblower channel; and
  • Drafting and revision of ombuds procedures.
